Terms of Use
These terms are the agreement between you and Aleph Collective LLC for the Neptune Weather app and service. By using Neptune, you accept them. If you do not, please do not use the app.
1. The most important part
Neptune is not a life-safety system
Weather forecasting is uncertain, and radar, model output, and automated storm tracking can all be wrong, late, or unavailable. Never use Neptune as your sole basis for a decision where life or property is at stake. For warnings that matter, rely on your official national weather service — in the United States, the National Weather Service (weather.gov) and NOAA Weather Radio — and on local emergency management.
Alerts, push notifications, arrival times, and Live Activities depend on network connectivity, Apple's push infrastructure, upstream data providers, and your device's settings. Any of them can fail or be delayed. Neptune does not guarantee that a notification will be delivered, delivered on time, or delivered at all.
2. Your account
You need an account to use Neptune. You are responsible for keeping your credentials secure and for activity under your account. You must be old enough to form a binding contract where you live, and at least 13. Give us an email address you actually control — it is how you recover access.
You can delete your account at any time from Settings → Account → Delete Account. We may suspend or terminate an account that breaches these terms, or that we are legally required to act on.
3. Subscription, billing, and cancellation
Neptune is sold as an auto-renewing subscription through the Apple App Store.
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the period ends, at the price shown in the app for your region.
- If a free trial is offered and you accept it, any unused portion is forfeited when you purchase a subscription.
- Manage or cancel your subscription in the App Store: Settings → your name → Subscriptions. Deleting the app does not cancel your subscription.
- Refunds are handled by Apple under Apple's policies; we cannot issue them directly.
We may change subscription pricing. Existing subscribers will be notified before a price change takes effect, and Apple will ask you to agree before charging a higher price.
4. What you may and may not do
Your subscription grants you a personal, non-exclusive, non-transferable licence to use Neptune on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not:
- share, resell, or sublicense your account or access;
- scrape, bulk-download, or systematically extract data from our API, or use it outside the app;
- use automated means to place load on the service beyond ordinary personal use;
- reverse-engineer, decompile, or attempt to derive our source code, except where that restriction is prohibited by law;
- use Neptune to build a competing weather product;
- use Neptune where doing so would breach export controls or sanctions law.
5. Weather data and attribution
Neptune blends public weather data from national meteorological agencies and open datasets, including NOAA/NWS, ECMWF, MET Norway, Environment and Climate Change Canada, and Deutscher Wetterdienst, together with map data from OpenStreetMap contributors via OpenFreeMap and elevation data from the AWS Terrain Tiles dataset. Those providers' licences and attributions are listed in the app under Settings → Data. Neptune's own forecast blend, presentation, and software are ours.
Those providers do not endorse Neptune and are not responsible for it. Upstream outages, degradations, or changes are outside our control and may affect what Neptune can show you.
6. Availability
We aim to keep Neptune running continuously, but we do not promise uninterrupted or error-free service. We may modify, suspend, or discontinue features. If we discontinue the service entirely while you hold a paid subscription, we will give reasonable notice.
7. Disclaimers and limitation of liability
To the fullest extent permitted by law, Neptune is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that forecasts, radar, alerts, or arrival times will be accurate, timely, or complete.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to Neptune is limited to the amount you paid us in the twelve months before the claim arose.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
8. Apple
Because Neptune is distributed through the App Store, the following apply:
- This agreement is between you and Aleph Collective LLC only, not with Apple. Apple is not responsible for Neptune or its content.
- Apple has no obligation to provide maintenance or support for Neptune.
- If Neptune fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Neptune.
- Aleph Collective LLC, not Apple, is responsible for addressing any claims relating to Neptune, including product liability, failure to conform to legal or regulatory requirements, consumer protection claims, and third-party claims that Neptune infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.
9. Changes to these terms
We may update these terms. If a change materially affects your rights, we will update the effective date above and notify you in the app before it takes effect. Continuing to use Neptune after that means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-laws rules. Nothing here removes any mandatory consumer protection you have where you live.
